GOOD SAMARITAN LAW

A 'Good Samaritan Law' is a law that protects someone giving emergency aid from suits for ordinary negligence.

To qualify for Good Samaritan protection, the care usually needs:

Is in response to an emergency; and

Is gratuitous [free of charge];

Is away from a doctor's office or other medical services.  A typical setting would be at a roadside accident.

If you provide medical assistance to a highway accident victim and later send him a bill your services are no longer 'gratuitous' and you lose the Good Samaritan protection.

Note that the aid giver is protected only from suits for ordinary negligence.   One can still be held liable for harm arising from reckless treatment.

Some states have adopted similar legislation to protect physicians who volunteer to be on hand for sports events like high school football.
